Judge Strikes Down NYC's Mask Mandate for 2-to-4 Year-Olds, Mayor will Uphold it

Mayor Eric Adams will not lift the city’s mandate for 2-to-4-year-olds to mask, even though Staten Island Judge Ralph Porzio struck down NYC’s masking order for toddlers, just hours before.

Not only did Judge Porzio strike down the mask mandate, he issued a permanent injunction against it, and called the mandate "arbitrary, capricious and unreasonable,” nbcnewyork.com reported.

On March 22, Mayor Adams announced a plan to make masks optional for the city’s youngest children, however, in a briefing today at City Hall, the mayor and Health Commissioner Ashwin Vasan, MD, said it would be irresponsible to lift the mask mandate for 2-to-4 year olds in light of the latest rise in COVID infections, as a new variant, BA.2, has been identified.

While hospitalizations and deaths, the most important metrics, remain on the decline in New York City, just in the past week, Covid transmission is again increasing.

“We want to see our babies’ faces,” Mayor Adams said at a news conference at City Hall, when he first announced the mandate would end on April 4 if cases remain low, but he added that he would not hesitate to “pivot” to another plan, if necessary.

Now, for the “foreseeable future,” Dr. Vasan said today, New Yorkers younger than 5 will have to “wait a little bit longer until masks are optional for this age group.”
